Terms of Service & Sale

1. Overview
This website is operated by Calm is Here — Entreprise Individuelle, Sofiia Gurova, 74940 Annecy, France. Throughout the site, the terms "I" refer to the studio. By visiting our site and/or purchasing a rug from me, you engage in my "Service" and agree to be bound by the following terms and conditions.

2. Custom Commissions & Orders
Design Approval: For custom rugs, production begins only after the client approves the final digital mockup.
Payment: Full payment is required upfront unless a specific deposit agreement is made.
Accuracy: I reserve the right to refuse any order. You agree to provide current, complete, and accurate purchase and account information for all purchases made at my store.

3. Intellectual Property
All designs, photos, and content on this website are the intellectual property of Calm is Here. You may not reproduce, duplicate, copy, or sell any portion of our designs or service without express written permission from us.

4. Pricing and Studio Modifications
Prices for our rugs are displayed in euros. TVA non applicable — article 293 B du CGI. I reserve the right at any time to modify or discontinue a product or service (or any part thereof) without notice.

5. Payment
Payment is due in full at the time of purchase. Accepted payment methods are displayed at checkout. Orders are confirmed only once payment has been successfully processed.

6. Handmade Disclaimer
Each rug is a unique piece of art hand-tufted in Annecy, France. By purchasing, you acknowledge that handmade items may have slight variations in color, texture, and shape compared to digital mockups. These are not considered defects.

7. Shipping & Delivery
Orders are dispatched within 2–4 business days. Delivery times and rates vary by destination and are detailed in our Shipping Policy. Risk of loss transfers to the customer upon handover to the carrier.

8. Right of Withdrawal
In accordance with French consumer law (Article L221-18 of the Code de la consommation), you have 14 days from receipt of your order to exercise your right of withdrawal, without needing to provide a reason.

Exception: Custom or personalised rugs produced to your specifications are exempt from the right of withdrawal under Article L221-28, as they cannot be resold to another customer.

To exercise your right of withdrawal, contact us at hello@calmishere.com before the deadline. The item must be returned in its original condition and packaging. Return shipping costs are the responsibility of the customer. Refunds are processed within 14 days of receiving the returned item.

9. Returns & Refunds
If your rug arrives damaged, please contact us at calmishere@gmail.com within 7 days of delivery with your order number and photos of the damage. I will assess the situation and offer a replacement or refund where applicable.

10. Legal Guarantees
In accordance with French law, all products are covered by:
- The legal guarantee of conformity (garantie légale de conformité) — Articles L217-4 to L217-14 of the Code de la consommation — for 2 years from delivery.
- The guarantee against hidden defects (garantie contre les vices cachés) — Articles 1641 to 1648 of the Civil Code.

These guarantees apply independently of any commercial guarantee offered by the studio.

11. Dispute Resolution
In the event of a dispute, you may contact us first at calmishere@gmail.com to seek an amicable resolution. If no agreement is reached, you may refer the matter to a certified consumer mediator free of charge. As a last resort, disputes are subject to the jurisdiction of the competent French courts.

12. Governing Law
These Terms of Service and Sale shall be governed by and construed in accordance with the laws of France.
